Welcome to VFX Spotlight (https://www.vfxspotlight.com). This Privacy Policy explains how HOOLY CORPORATION, S.A. ("we," "us," or "our") collects, uses, shares, and protects your personal information when you use our platform ("Platform").

We are committed to protecting your privacy and handling your data transparently and securely. Our goal is to collect only the information necessary to provide and improve our services for the global visual effects community.

1. Information We Collect

We collect information to provide a functional and efficient platform for connecting VFX Artists and Employers. We strive to collect only what's needed for the specific purpose.

  • Information You Provide Directly:

    • Account Information: When you register, we collect basic information like your name and email address. We require a real email address; temporary or disposable emails are not permitted.
    • Profile Information: You may choose to provide additional information for your public Artist or Representative profile, such as skills, experience, professional bio, location (city/country level), and portfolio links/content. Sharing this information is optional but necessary to fully utilize the Platform's networking features.
    • Contractual Information (Artists): To facilitate contracts initiated through the Platform, Artists accepting a Bid must provide specific information required by the Representative (e.g., legal name, physical address, tax ID). This information is requested only when necessary for contract finalization, stored securely, and used solely for populating the contract.
    • Communications: We collect information when you communicate with us (e.g., support requests) or with other users through the Platform's messaging system.
  • Information Collected Automatically:

    • Usage Data: We may collect information about how you interact with the Platform, such as pages visited, features used, searches performed, and timestamps of activity. This helps us understand usage patterns and improve the service.
    • Device and Connection Information: We may collect technical information about your device, browser, IP address, and operating system to ensure compatibility and security.
    • Cookies and Analytics: We use cookies and similar technologies for essential site functions and, with your explicit consent, for analytics. See the Cookies and Analytics section for details on how we use cookies and analytics, and how you can control your preferences.
  • Information We Do NOT Collect:

    • We do not intentionally collect sensitive personal information, such as data concerning health, race, ethnicity, political opinions, religious beliefs, sexual orientation, or gender identity.

Google User Data Usage

When you sign in using your Google account, we collect the following information from your Google profile:

  • Your name
  • Your email address
  • Your profile picture (if available)

We use this data solely to:

  • Authenticate your identity and log you into the app
  • Create and personalize your VFX Spotlight user account

We do not use this data for advertising purposes.
We do not share this data with third parties, except as necessary to provide the service (e.g., cloud hosting providers under strict data agreements).

You can request deletion of your account and associated data at any time by contacting us at info@vfxspotlight.com.

Cookies and Analytics

We use cookies and similar technologies to provide essential site functions and, with your explicit consent, to enable analytics that help us improve the Platform.

  • Essential cookies are required for the site to function (e.g., keeping you logged in, remembering preferences).
  • Analytics cookies (Google Analytics) are only enabled if you provide explicit consent via our privacy settings banner. These cookies help us understand how users engage with the Platform.

How consent works:

  • On your first visit, you will see a privacy settings banner. Analytics will only be enabled if you accept or enable analytics in the Privacy Settings dialog.
  • You can withdraw or re-grant consent at any time by clicking the Privacy Settings (shield) icon in the site footer. This opens a dialog where you can enable or disable analytics cookies.
  • If you withdraw consent, all analytics cookies are immediately removed and tracking is disabled. No analytics data is collected or sent to Google Analytics until you re-enable consent.
  • If you do not provide consent, no analytics cookies are set and no analytics data is collected.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Operate the Platform: To create and manage accounts, display profiles, facilitate searches and connections between Artists and Employers, process Bids, and enable communication.
  • To Improve the Platform: To analyze usage patterns, understand user needs, fix bugs, develop new features, and enhance the user experience.
  • To Communicate With You: To send service-related notifications (e.g., new messages, Bid updates), respond to inquiries, and inform you about significant changes to our Platform or policies.
  • For Security and Compliance: To protect the security and integrity of the Platform, prevent fraud and abuse, enforce our Terms of Service, and comply with applicable legal obligations.
  • Contract Facilitation: To use the specific Contractual Information provided by Artists solely for populating contracts when a Bid is finalized by a Representative.

3. How We Share Your Information

Your privacy is paramount. We do not sell your personal data to third parties.

We share information only in the following limited circumstances:

  • Public Profiles: Information you choose to include in your public Artist or Organization profile will be visible to other registered users of the Platform as intended by the service's functionality.
  • Contract Population: After an Artist accepts a Bid, the specific Contractual Information they provided (as described in Section 1) is used to populate the contract template associated with that Bid. This allows the Representative to review the complete contract draft before choosing to finalize the Bid.
  • Service Providers: We may share information with third-party vendors and service providers who perform services on our behalf (e.g., hosting providers, email delivery services, analytics providers). These providers are contractually obligated to protect your data and use it only for the services we request.
  • Legal Requirements: We may disclose your information if required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (a) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (b) enforce our agreements with you; (c) investigate and defend ourselves against any third-party claims or allegations; (d) protect the security or integrity of our Platform; or (e) exercise or protect the rights and safety of HOOLY CORPORATION, S.A, our users, personnel, or others.
  • Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred as part of such a transaction, as permitted by law and/or contract.

4. Data Security

We implement reasonable technical and organizational security measures designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. However, no internet transmission or electronic storage is 100% secure, so we cannot guarantee absolute security.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Platform services. We may also retain information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

5a. Account Deletion and Data Retention

If you choose to delete your account, we will take steps to ensure your personal information is removed or anonymized in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

What happens when you delete your account:

  • Your name and profile information will be anonymized. For example, your display name will be replaced with a generic label such as "Deleted User."
  • Your email address will be replaced with a hashed, non-reversible value. This means your original email is no longer stored in our systems and cannot be recovered or used to identify you.
  • Any profile images or other personal media will be removed.
  • Associated data such as skills, credits, and gallery items will be deleted.
  • Your location and biography information will be cleared.
  • If you have open or pending transactions (such as job bids), these will be closed or declined in accordance with our platform's business rules.
  • Your historical activity (such as finalized transactions or messages) may be retained in anonymized form to maintain the integrity of our platform and for legal or audit purposes.

Anti-abuse and fraud prevention:
To protect our community and prevent abuse, we retain a hashed version of your email address after account deletion. This hash cannot be used to identify you or contact you, but it allows us to detect and prevent attempts to re-register with the same email address for fraudulent purposes. This process is fully compliant with GDPR and CCPA, as the hashed value is not personally identifiable information and is retained solely for security and anti-abuse reasons.

Your rights:

6. Your Rights and Choices

Depending on your location and applicable data protection laws (such as GDPR in Europe or CCPA in California), you may have certain rights regarding your personal information:

  • Access: You can review and update most of your account and profile information directly through your account settings.
  • Correction: You have the right to request correction of inaccurate personal information we hold about you.
  • Deletion: You can request the deletion of your account and associated personal information, subject to legal and contractual retention requirements.
  • Objection and Restriction: You may have the right to object to or request restriction of certain processing activities.
  • Data Portability: You may have the right to request a copy of your information in a machine-readable format.

7. International Data Transfers

As a global platform, your information may be transferred to and processed in countries other than your own, including Panama where HOOLY CORPORATION, S.A is incorporated. We take steps to ensure that your data receives an adequate level of protection in the jurisdictions in which we process it.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you either through the email address associated with your account or by posting a prominent notice on the Platform prior to the change becoming effective.
